Contested and Uncontested Divorce

Divorce Attorney LeavittNot every divorce has to be filled with confrontations and arguments. In where children are involved, you and your ex-spouse may have to maintain a working relationship with each other. Being able to continue parenting together is easier to do if you are able to agree on matters related to your divorce through negotiation.

Uncontested divorce means that you and your spouse have been able to agree on some things — perhaps how you will divide your assets or who gets custody — and you just want help negotiating the remaining issues. If you think that you can resolve things amicably, then this may be the best solution for you.

Contested divorce means that you and your spouse have not been able to agree to anything — from child custody and support, parenting plans, spousal support, division of assets — and requires filing a lawsuit.

Whether you are able to come to an agreement out of court, or need to take your matter before the judge, I — Attorney Neil Leavitt — am here to help you. Don't let my personable and easy going manner deceive you — I am aggressive in the courtroom and will fight to protect your rights and see that you get the result that you deserve.

Misconceptions About Divorce

You may think that if your marriage was too short, you are not entitled to any sort of support. However, you may be able to receive compensation for sacrifices made during your marriage. I can help you determine if you have a claim for spousal support or alimony.

You also may think that all of your property will be equally divided between you and your spouse. But Florida is an equitable distribution state, not a community property state. Any assets that were not combined during the marriage, such as an inheritance or vacation property you owned before you got married, remain yours after the divorce.

To learn more about how property is divided in an equitable distribution state, see my Divorce Information Center.

To find out whether you are entitled to spousal support, or to learn more about how I can help you divide your marital property, contact me online or by calling 954-335-7025.
